Film Limited “Life Time” Warranty For Personal Light Vehicles

Avery Dennison paint protection Nano-Fusion™ 6 mil film (“Product”) has a limited warranty from date of purchase. The film is warranted to be free from defects in manufacturing and workmanship and against peeling, yellowing, bubbling, or cracking of the film from UV exposure for so long as the original purchaser owns and operates the Vehicle on which the Product is installed.

To be valid, this warranty requires that the installation is performed by an authorized Avery Dennison installer in accordance with Avery Dennison’s recommended installation procedures and the owner must follow recommended maintenance requirements (including those relating to washing and/or waxing or applying other surface treatments) and procedures and retain the original proof of purchase and completed certificate provided by the authorized installer. In the event that the Product is not installed by an authorized Avery Dennison installer, then the warranty shall be for a term of seven (7) years from the date of purchase.

This warranty does not apply to damage to the Product caused by erroneous application, accident, intentional misuse, exposure to corrosive or abrasive materials, ordinary wear, or dents caused by physical impact (e.g. stones, road debris, bumps, impact, etc.) or use of the Vehicle in commercial or for profit service. If Avery Dennison determines that the Product has been damaged due to failure to follow Avery Dennison’s application or recommended maintenance procedures, Avery Dennison WILL NOT reimburse the authorized Avery Dennison installer. Avery Dennison’s sole obligation under this warranty shall be the replacement of the defective film, and in no event shall Avery Dennison’s liability exceed the purchase price of the film.

Claim Procedures

Warranty claims may be made by returning your Vehicle to an Avery Dennison authorized installer for the Product. Warranty coverage is applicable to the original purchaser and is not transferable. Proof of purchase and the original certificate will be required by the authorized installer and may need to be validated by Avery Dennison prior to replacement. If a customer has questions regarding the warranty he or she is directed to contact the authorized distributor of the Avery Dennison Product.

Any purchaser requiring a replacement should contact the nearest Avery Dennison authorized installer or visit the Avery Dennison paint protection film website at www.nano-fusion.net. Please provide a copy of your original receipt and the installer executed Product registration card. Your materials or copies will not be returned and you should retain your original registration materials in a safe place.

Exclusivity

The foregoing warranty is exclusive and in lieu of all other warranties, express or implied, including but not limited to warranties of merchantability and/or fitness for a particular purpose. All other warranties, except those set forth above are expressly excluded.

The foregoing comprises Avery Dennison’s sole and entire warranty and no waiver, alteration, additions or modifications of the foregoing conditions shall be valid unless made in writing or signed by an officer of Avery Dennison.

AVERY DENNISON SHALL HAVE NO LIABILITY TO CUSTOMER OR ANY THIRD PERSON (e.g. INSTALLER) RELATING TO THE ADEQUACY, ACCURACY OR SUFFICIENCY OF ANY TECHNOLOGY, INSTRUCTION OR INFORMATION OR ANY ASPECT THEREOF PROVIDED BY AVERY DENNISON. AVERY DENNISON HEREBY EXPRESSLY DISCLAIMS ANY WARRANTIES CONCERNING THE SUFFICIENCY OF ANY SUCH TECHNOLOGY, INSTRUCTIONS AND INFORMATION, ITS MERCHANTABILITY AND/OR FITNESS FOR ANY PURPOSE. ANY IMPLIED WARRANTY OR CONDITION ARISING OUT OF A COURSE OF DEALING OR OF PERFORMANCE OR CUSTOM OR USAGE OF TRADE ARE LIMITED IN DURATION TO THE APPLICABLE WARRANTY TIME PERIOD. ANY TECHNOLOGY, INSTRUCTIONS AND INFORMATION DELIVERED UNDER THIS AGREEMENT SHALL BE DELIVERED "AS IS" AND "WITH ALL FAULTS." Without limiting the foregoing disclaimers, Avery Dennison specifically makes no warranty whatsoever for any defects in any drawings, designs, information and/or technical assistance supplied under this Agreement, or any inability of the customer or installer to use the Product to any given specification, or any claim of customer or installer, its customers, or any third party with respect to the use of the technical information or assistance furnished by Avery Dennison relating to the Product.

Limitations

Except where prohibited by law, Avery Dennison and the authorized Avery Dennison installer shall not be liable for loss or damage arising from the Product, whether direct, indirect, special, incidental or consequential regardless of the legal theory asserted. Some jurisdictions do not permit the exclusion or limitation of consequential or incidental damages or how long an implied warranty, if any, may last, so the above limitations may not apply to you. This warranty gives you specific legal rights in addition to other rights which vary from area to area.

The Product is to be used in accordance and compliance with all applicable state or provincial laws. Installation of this Product in a manner that violates state or provincial laws, or interferes with the operation of the Vehicle is considered a misuse of the Product and voids all warranties. Avery Dennison shall not be liable in any manner whatsoever for damages related to the use of this Product in an illegal manner.

* This warranty does not apply to Vehicle s used in fleet, courier, livery, rental or other commercial or for profit service as well as Vehicles used in racing, rally sports or off-road activities. Vehicle as defined herein includes personal automobiles and recreational vehicles (“RVs”).
